Sporting Succession case before the FIFA Disciplinary Committee

Sporting Succession case before the FIFA Disciplinary Committee

AP Sports Law successfully represented an amateur football club (the Claimant) before the FIFA DC, regarding a case of sporting succession.

The Original Debtor (Old Club) was dissolved and entered liquidation procedures back in 2018.

In 2019, we obtained a FIFA DRC award for the payment of training compensation by the Original Debtor.

Immediately after the Original Debtor was dissolved and disaffiliated from its national football association, a New Club emerged, with similar features and characteristics to the Original Debtor, including the name, badge, colours, stadium, city of establishment, social media, and history.

Following a petition before the FIFA Disciplinary Committee on the basis of art. 21 of the FIFA Disciplinary Code, we managed to obtain a positive decision, determining that the new club is the sporting successor of the Original Debtor. Notably, it was the first succession decision concerning this club.

Thus, the FIFA DC ordered the sporting successor to pay the total amount awarded to the amateur football club through the FIFA DRC decision, plus the corresponding interest payments as of 2016.

We are glad to have successfully represented an amateur club before FIFA, in such a demanding case and to successfully receive the training rewards remaining unpaid since 2016.
